Pacheco Coto's Litigation and Arbitration Division has extensive experience and expertise representing both corporate and individual clients on a complete range of dispute resolution and litigation procedures.

Highly specialized attorneys, including a former Superior Tribunal President, counsel the Firm's clients on complex civil, commercial, constitutional, administrative, labor and criminal procedures.

The Litigation and Arbitration Team frequently works in conjunction with the Firm's other Divisions, thus providing its clients with comprehensive legal strategies pertinent to their specific requirements. Such is the case, for example, concerning the Division's participation with the Business Law Division in distributorship and agency disputes, where the Firm's attorneys have successfully represented both local agents and foreign businesses in landmark trials.

Recognizing the importance that dispute resolution has attained in modern business transactions, the Division's attorneys have specialized in all aspects of national and international negotiation, conciliation and arbitration, participating not only as legal counsel to clients, but also as founders and members of the International Center for Conciliation and Arbitration of the Costa Rican-American Chamber of Commerce and as conciliators and arbitrators in these innovative processes.

The following are examples of the Litigation and Arbitration Division's notable engagements:

  • Successfully representing a Japanese company in one of the few distribution and agency cases in Costa Rica where the distributorship was terminated without having to indemnify the local representative.
  • Successfully representing a German automotive manufacturer in the remission of a local commercial procedure to German Courts in a distributor and agency dispute, where such remissions are very unlikely.
  • Successfully representing a local agent in an arbitration procedure against a mayor Central American Airline Company, obtaining a US$2 Million indemnification for the termination of an agency agreement.
  • Successfully representing a mayor Irish tourist operator in an international arbitration proceeding held in Amsterdam, against a local representative, obtaining a favorable laud and a substantial indemnification.
